Part I — Use of the Website

1. Scope

Part I applies to anyone who accesses the Website. Part II applies to anyone requesting a consultation and supplements the contract for professional services.

2. Nature of the content

The Website is informational and institutional. The content published, including the articles, does not constitute legal advice and is no substitute for examining the specific case.

Sending the contact form or a consultation request does not create any professional relationship, which arises only when the Lawyer accepts the engagement.

3. Intellectual property

The Website content is protected by Law 633/1941. Reproduction, even in part, without written permission is prohibited, except for the right of quotation under art. 70 of that Law.

4. Liability

The Owner takes care over the accuracy of the content but does not guarantee that it is free from errors or up to date with subsequent changes in the law.

The Owner is not liable for the content of third-party websites reachable through links, over which it has no control.

The mandatory limits of art. 1229 of the Italian Civil Code and art. 33(2)(b) of the Italian Consumer Code remain unaffected: no clause in this document excludes or limits liability for wilful misconduct or gross negligence, or for personal injury.

5. Security

The Owner adopts appropriate technical and organisational measures. Users, in turn, adopt suitable IT protection measures.

6. Changes

The Owner may amend these Terms. Changes apply to use after publication and do not affect relationships already concluded, which are governed by the version in force when they were concluded.

Part II — Legal consultation

7. Subject matter

The consultation consists of a preliminary examination of the matter submitted, an analysis of the documents available and guidance on the possible scenarios. It does not include drafting documents or written opinions, nor taking on the case, which are the subject of a separate agreement.

8. Fees

The fee is set according to the complexity of the matter, assessed on the basis of the quantity and nature of the documents to be examined, the number of positions involved, any pending deadlines and the urgency required.

  • In the office, 60 minutes: from € 100 to € 300;
  • Video conference, 60 minutes: from € 80 to € 240;
  • By telephone, 30–45 minutes: from € 70 to € 210.

The amounts include VAT and the Cassa Forense (lawyers’ pension fund) contribution and are all-inclusive: no further cost is due for the consultation.

The exact amount is communicated in writing to the applicant when the appointment is set, before the contract is concluded, together with the payment methods. The fee is due only if the consultation takes place, and is paid at the time of the consultation.

9. Nature of the booking request

A booking request is not a contractual offer and does not bind either party. It is an expression of interest in an initial discussion.

No fee is due or payable when the request is made. The Firm is not obliged to set an appointment; the applicant is not obliged to attend.

The Firm may decline the request, in particular where there is a conflict of interest under arts. 24 and 68 of the Italian Code of Conduct for Lawyers.

The contract for professional services is concluded at the start of the consultation, on the subject matter set out in art. 7 and for the fee previously communicated under art. 8.

10. Subsequent engagements

For every engagement following the consultation, a written quote is issued under art. 13(5) of Law 247/2012, distinguishing between professional fees, charges and expenses. No mandatory minimum tariffs apply, as they were abolished by art. 2 of Decree-Law 223/2006, converted by Law 248/2006.

The details of the professional liability insurance policy taken out under art. 12 of Law 247/2012 (insurer, number, limit of cover and territorial scope) are communicated to the client in writing when the engagement is given and, on request, before the consultation.

11. Consumer right of withdrawal for remote consultations

This clause applies to clients acting for purposes outside any business, commercial, craft or professional activity they may carry on, and only to consultations by video conference or telephone, concluded without the simultaneous physical presence of the parties and therefore distance contracts under art. 45(g) of the Italian Consumer Code. Consultations in the office, concluded on the professional’s premises, are not subject to withdrawal.

The consumer has the right to withdraw within fourteen days of the conclusion of the contract, without giving reasons and at no cost, by sending an explicit statement to segreteria@studiobarnaba.it. The model form below may be used, but its use is not mandatory. Any sums paid are refunded within fourteen days using the same means of payment.

Immediate performance. Since a remote consultation begins at the very moment the contract is concluded, when the connection starts the consumer is asked to expressly request immediate performance and to acknowledge the resulting loss of the right of withdrawal once the service has been fully performed, under art. 59(1)(a) of the Italian Consumer Code. The statement is confirmed in writing in the summary communication.

Without that statement, the right of withdrawal can still be exercised even after the service has been performed.

12. Failure to attend

As the applicant has no obligation, failing to attend the appointment entails no charge. Advance notice is appreciated so that the time slot can be reassigned.

13. Confidentiality

Anything learned during the consultation is covered by professional secrecy under art. 6 of Law 247/2012 and arts. 13 and 28 of the Italian Code of Conduct for Lawyers, even if no engagement follows.

14. Artificial intelligence tools

Under art. 13 of Law 132 of 23.09.2025, the Firm informs clients that, in carrying out consultations and engagements, it may use artificial intelligence systems in a purely instrumental and supporting role: organising documents and deadlines, legislative and case-law research, summarising and analysing documents, preparing drafts.

Every assessment, opinion and document remains the result of the Lawyer’s intellectual work; the Lawyer personally checks sources and content and takes full responsibility for them. No decision concerning the client is entrusted to an automated system.

The systems used are specified, for each engagement, in the engagement letter.

15. Complaints and dispute resolution

Complaints should be sent to segreteria@studiobarnaba.it. The Firm replies within thirty days.

This is without prejudice to recourse to the alternative dispute resolution bodies under Part V, Title II-bis, of the Italian Consumer Code, and to the jurisdiction of the Bar of Bari.

16. Governing law and jurisdiction

These Terms are governed by Italian law.

For disputes with consumers, the court of the consumer’s place of residence or elected domicile has exclusive jurisdiction, under art. 33(2)(u) of the Italian Consumer Code.

For disputes with clients who are not consumers, the ordinary rules on jurisdiction apply.
